互聯網保險監管升級 中小險企盼跨區銷售險種擴容

  近日(rì),銀保監會下發了《關于繼續加強互聯網保險監管有關事(shì)項的通知》。銀保監會表示,正在加快(kuài)《互聯網保險業務監管暫行辦法》(以下簡稱《暫行辦法》)的修訂工(gōng)作,在新的規定出台以前,原《暫行辦法》繼續有效.據悉,《暫行辦法》于2015年(nián)10月1日(rì)起施行,施行期限爲3年(nián)。

  3年(nián)來(lái),随着互聯網金融迅猛發展,互聯網保險業務也呈現加速發展态勢。而随着互聯網保險驅動方發生根本變化,保險公司向平台所有者轉變,一些新的風(fēng)險趨勢有所冒頭,對現有的監管制度提出了挑戰。此前,銀保監會允許意外險、定期壽險等保險業務可(kě)以擴展至未設分(fēn)公司的省、自(zì)治區和直轄市。而此次修訂《暫行辦法》是否放(fàng)開更多險種,如(rú)重疾險跨區銷售成爲險企關注的一個焦點。

  互聯網保險格局生變,中國互聯網保險起步很早,引爆市場的一個标志性事(shì)件(jiàn)是,2012年(nián)12月國華人(rén)壽通過淘寶聚劃算平台借助萬能險産品創造了三天一億元的銷售神話(huà)。2013年(nián)國内首家互聯網保險公司衆安在線财産保險獲得(de)原保監會批準成立,此後中國互聯網保險進入高速發展階段,互聯網保險的保費幾乎每年(nián)上一個台階。2015年(nián)以來(lái),随着互聯網保險驅動方發生根本變化,一些新的問(wèn)題和風(fēng)險趨勢有所冒頭,對現有的監管制度和監管環境提出了挑戰。

  如(rú)第三方網絡平台數量巨大(dà),新媒體(tǐ)、新技術(shù)參與程度較高,對保險業務手續費、經營流程、資金收付等進行深度掌控,通過與保險公司的業務合作,間接受保險監管部門(mén)監管,不受保險監管部門(mén)直接或實質性監管。這導緻保險監管規定的信息披露要求、資金收付要求、手續費支付要求等往往在業務實踐中難以得(de)到有效的貫徹落實,帶來(lái)較大(dà)的合規風(fēng)險。

  某些在線平台暗藏“搭售”,通過默認勾選的方式銷售一些保險産品,未明确列明承保主體(tǐ)或代理(lǐ)銷售主體(tǐ),未完整披露保險産品條款等相(xiàng)關重要信息,侵害了消費者的知情權、自(zì)主選擇權等。

  中小保險公司在目前互聯網保險環境下亦生存艱難。從(cóng)目前的格局來(lái)看(kàn),保費仍然明顯向大(dà)公司集中。據中保協的數據,2018年(nián)上半年(nián),保費規模*大(dà)的8家保險公司累計(jì)實現互聯網财險保費收入235.70億元,占該市場的份額爲72.21%。

  “中小公司互聯網保險業務批下來(lái)也沒法活,在現在這個環境,隻要一做業務就(jiù)虧。前三大(dà)保險公司占62%的互聯網保險份額,*後39家小的保險公司在保費環節每家不足10億元,這個數字觸目驚心。”某中小保險公司高管感歎。

  同時,互聯網保險的内涵與外延發生了很多變化,由作爲渠道或場景銷售保險爲主逐漸過渡到保險科(kē)技賦能保險的内涵。而《暫行辦法》很大(dà)程度上還(hái)是沿用*早的互聯網保險定義,以通過互聯網渠道銷售保險産品爲主來(lái)衡量和評定,需要結合新形勢和環境進行修改,提升監管的适應性。

  記者獲悉,近日(rì)銀保監會下發《關于繼續加強互聯網保險監管有關事(shì)項的通知》,其重申2015年(nián)原保監會發布《暫行辦法》以來(lái),互聯網保險業務持續健康發展,服務能力不斷增強。銀保監會表示,正在加快(kuài)《暫行辦法》的修訂工(gōng)作,在新的規定出台以前,《暫行辦法》繼續有效。

  一位不願具名的保險監管人(rén)士表示,既要提升監管的适應性,也要保持監管的穩定性。對互聯網保險監管采取相(xiàng)對開放(fàng)的态度,對于互聯網保險作業模式與原有監管規則之間的沖突,不能簡單從(cóng)合規的層面予以否定,應該從(cóng)更深層面查找規則的邏輯基礎,以風(fēng)險防範爲*終目的,尋求規則适應與鼓勵創新之間的平衡。

“原有監管規則被打破以後,新的規則要及時跟上,對監管來(lái)說(shuō),守住風(fēng)險底線是硬道理(lǐ)。”該保險監管人(rén)士說(shuō)。

  跨區銷售險種引關注

  銀保監會在文件(jiàn)中表示,其正在積極推進互聯網保險監管的各項工(gōng)作,要求各保險機(jī)構要切實加強産品創新能力、風(fēng)險管控能力、客戶服務能力建設,要求保險機(jī)構認真落實互聯網保險業務經營區域和信息披露有關要求,強化保險消費者保護,确保互聯網保險業務合規經營。

  在《暫行辦法》中,原保監會允許保險代理(lǐ)公司和保險經紀公司在具備銷售互聯網保險的條件(jiàn)和完成互聯網保險備案之後,即可(kě)以借助互聯網銷售保險産品。保險公司也可(kě)以自(zì)建互聯網渠道和借助完成互聯網備案的互聯網平台銷售保險。

  特别是原保監會在《暫行辦法》中提出:“保險公司在具有相(xiàng)應内控管理(lǐ)能力且能滿足客戶服務需求的情況下,可(kě)将下列險種的互聯網保險業務經營區域擴展至未設立分(fēn)公司的省、自(zì)治區、直轄市:(一)人(rén)身(shēn)意外傷害保險、定期壽險和普通型終身(shēn)壽險;(二)投保人(rén)或被保險人(rén)爲個人(rén)的家庭财産保險、責任保險、信用保險和保證保險;(三)能夠獨立、完整地通過互聯網實現銷售、承保和理(lǐ)賠全流程服務的财産保險業務;(四)中國保監會規定的其他(tā)險種”。

  目前,市場上有超過100家保險公司開展了互聯網保險業務,特别是中小保險公司希望借助互聯網渠道實現跨越式發展,所以中小保險公司希望銀保監會放(fàng)開更多的險種跨區銷售。

  有知情人(rén)士透露,此前銀保監會對互聯網保險監管辦法征求意見(jiàn)。不過,目前并未見(jiàn)銀保監會公開發布新的互聯網保險監管辦法征求意見(jiàn)稿。事(shì)實上,記者在采訪中了解到,中小壽險公司希望放(fàng)開重疾險、分(fēn)紅(hóng)險、年(nián)金險、萬能險和投連險等産品全國銷售。而中小财險公司則希望放(fàng)開重疾險(包括百萬醫療之類的健康險産品)、車險等産品全國銷售。

  有小型保險公司人(rén)士認爲,可(kě)以放(fàng)開重疾險(包括百萬醫療産品)、年(nián)金險、車險等更多産品跨區銷售,像重疾險、年(nián)金險這類産品其實理(lǐ)賠服務不多,而且第三方服務公司很多,保險公司完全可(kě)以交給第三方服務公司來(lái)做;而車險跨區銷售,此前衆安保險、泰康在線已經進行了嘗試,也并未引起市場本質的變化,而且中保車服也已經成立,完全可(kě)以進行更多範圍的嘗試。

  不過,大(dà)型保險公司卻并不這麽認爲,特别是重疾險、車險這類産品屬于重服務的産品,放(fàng)開中小保險公司跨區銷售反而會影(yǐng)響保險服務,因爲中小保險公司的服務能力跟不上。業内有觀點認爲,分(fēn)支機(jī)構的數量一定程度上會影(yǐng)響将來(lái)健康險理(lǐ)賠便利性,一般開設在非消費者所在地的分(fēn)支機(jī)構對消費者的價值有限,除非該用戶未來(lái)會移居到該地區生活工(gōng)作。來(lái)源:圈中人(rén)

France-based eyewear maker Essilor International S.A. has discovered fraudulent activities at one of its factories in Thailand that could cause €190 million ($213 million) in financial losses to the company, The Irish Times reported citing Reuters.
